Clarity Trip Planner, Go2Track Traveller Tracking Service, Go2Mobile Traveller App - Terms and Conditions

By using the Clarity Trip Planner Mobile Service and/or Go2Track Traveller Tracking Service and/or Go2Mobile App Service (together “the Services”) you indicate that you accept the following terms and conditions (“Terms”):

The Service is provided to you by Clarity of Level 13, The Broadgate Tower, Primrose Street, London EC2A 2EW (“Clarity”) as an additional source of travel and flight information. It is not intended to be authoritative and should only be used as a guide in conjunction with other sources of information. The Service is based on fast-moving real-time information supplied by third parties and its delivery is subject to the availability and operation of mobile networks. Accordingly, the Service is provided on an "as is" and "as available" basis without any representation, endorsement or warranty of any kind, express or implied (by law or otherwise) to the maximum extent permitted by law. Specifically, Clarity does not warrant: (1) that the Service will be uninterrupted or error free; (2) that any defects which may occur will be corrected; (3) that the Service is free from bugs, defects or viruses; or (4) the accuracy of the Service content.

Clarity may vary these Terms at any time.

Clarity will provide the Service from the time you subscribe until you cancel your subscription or until the Service is withdrawn.

Clarity may cease or terminate provision of the Clarity Trip Planner at any time.

You agree that you will: co-operate with Clarity, provide accurate information, ensure your mobile phone or other device is capable of receiving the Services and, in respect of the Clarity Trip Planner, only provide details of your own mobile phone number and email address. You agree that you will not allow anyone else to use the Services, to have access to any information which is made available through the Services and you will not disclose your password or details to any unauthorised third party.

Clarity is not liable for charges levied on you by your mobile network operator or internet provider for the delivery of the content of the Services to your mobile phone or other device.

In order to use the Services, you must obtain access to the internet, either directly or through devices that access web-based content, and you are responsible for any charges or service fees associated with such access including security of your access.

You are responsible for all equipment necessary to make such connection to the internet, including a computer and modem or other access device. You acknowledge that your access to the content of the Services may be affected by network outages for reasons including (1) caused by any failures of your equipment, systems or local access services, (2) for scheduled or emergency maintenance; and (3) relating to events beyond our control such as strikes, riots, insurrection, fires, floods, explosions, governmental action, labour conditions, earthquakes, natural disasters, or interruptions, power or utility shortages. Clarity shall have no liability to you if events beyond its control prevent it from performing its obligations.

Clarity's maximum liability in connection with the Services, howsoever arising, is limited to the price paid (if any) by you for the Services. In no event shall Clarity be liable for any direct or indirect loss, consequential loss or damage, loss of profit or goodwill, loss arising from any errors, omissions or interruption in the Services, loss arising from any incompatibility of the Services with your system or device, or loss or damage due to any bug, defect, computer virus, worm, trojan horse or other malicious code. Nothing in these Terms shall limit Clarity’s liability for; (i) death or personal injury caused by Clarity’s negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any other liability that cannot be limited or excluded under English law.


You agree that any information you submit to Clarity will be processed in accordance with Clarity's Privacy Policy, which forms part of these Terms (available at https://www.claritybusinesstravel.com/privacy-policy). Without prejudice to the generality of the terms of the Privacy Policy, you agree that (i) Clarity may disclose your information to third parties to the extent necessary to fulfil its obligations under these Terms, including (without limitation) in order to provide you with the Services; and (ii) Clarity and its trusted partners may send you information regarding the Services, improvements to the Services and other services Clarity believes may be of interest to you.

All intellectual property rights in the Services shall remain at all times the property of Clarity or Clarity's licensors.

These Terms are subject to English law and the parties agree to submit to the jurisdiction of the English courts. Clarity may assign or otherwise transfer its obligations at any time. If any parts of these terms are found to be invalid or unenforceable the other provisions shall remain in force.
